Do the owners own the land, or is it under a 99-year lease?

  1. The property and its domiciles are registered in a Mozambican Legal entity, of which directors and shareholders can be amended, added, and changed at any time.
  2. The second portion with the swimming pool and staff quarters have been purchased and agreements in place. Registration has just not yet been verified.
  3. NO 99 Year lease.

With all the paperwork in hand and with a lawyers assistance, this can be registered into the name of the company.

Can the rights, title deeds, and building plans be verified?

  1. Yes. All documentation, ‘alvera’, ‘duat’, etc. are in place and registered to the business.
  2. Building plans are up to date and approved by the local authorities,
  3. All taxes and INSS paperwork is up to date.

How does the transfer process work?

  1. Each application could be different depending on the buyer’s requirements; purchasing option; and in some cases, nationality.
  2. It will usually be handled by a Mozambican Attorney that will handle most of the processes.
  3. An agreement will be drafted and signed, payment will be made, and then the property will be transferred.
  4. It is mostly the same as other countries, with the exception that all paperwork is done IN PERSON, and must be original documentation.
  5. This mitigates any fraudulent transactions.

Can buyers further construct on the property?

  1. There is limited space left on the property, and should any MAJOR changes want to be made, you will have to consult a Mozambican Architect. They will guide you through the process.

Is there VAT on the transaction?

  1. Yes, but that is an amount for the sellers account, unless otherwise described in the purchase agreement.
